Can RTL-TVi and Club RTL be diffused in Belgium without the CSA's authorization? Or how to skirt a national legislation due to the "Television Without Frontiers" Directive?

En effet, cette directive prévoit une reconnaissance mutuelle des autorisations délivrées dans d’autres États membres. Or TVi avait en l’espèce déjà obtenu une autorisation au Luxembourg. Under Belgian law, this seems understandable but not so in connection with the directive "Television Without Borders". Indeed, this directive aims to ensure the free provision of broadcasting services within the internal market and provides for mutual recognition of authorizations delivered in other member states. In this case, Tvi had already obtained an authorization from the Luxemburg authorities.
